General Terms and Conditions of Sale

These general conditions of sale apply to all sales concluded on the exentrikco.com website, between:
EXENTRIK SAS, hereinafter after the "Seller" or the "Company" on the one hand,
and any natural or legal person proceeding to the purchase of products or services of the Company, hereinafter the "Buyer" or the "Customer" on the other hand,
subject to the special conditions indicated in the presentation of the products.

1 - MANDATORY INFORMATION

2 - ESSENTIAL CHARACTERISTICS OF PRODUCTS AND SERVICES SOLD

The exentrikco.com website sells:
Sports clothing and accessories, food supplements (products under development), as well as energy drinks (products under development).
The Customer declares having read and accepted the general terms and conditions of sale prior to placing his order.
The validation of the order is therefore valid for acceptance of the general terms and conditions of sale.

3 - PRICE

The prices of the products are indicated in euros all taxes included (TTC) and precisely determined on the pages of descriptions of the products.
The prices take account of possible reductions which would be granted by the Seller on the website exentrikco.com.
In the case of an order delivered in a country other than metropolitan France, the Customer is the importer of the products he buys.
For all products shipped outside the overseas collectivities or the European Union, the invoice is established on the price excluding taxes.
The Customer is solely responsible for declarations and payments of any customs duty or other tax likely to be payable in his country.
Delivery charges are not included in the price of the products.
The order form indicates the amount of delivery and / or handling charges before placing an order. The Seller reserves the right to modify his price at any time in the future.

4 - PRODUCT AVAILABILITY DEADLINE

The available products appear on the website accompanied by the mention "In stock".
In order to best meet the expectations of the Customers, the availability of products is regularly updated on the website.
Product offers are valid as long as they are visible on the website, within the limits of available stocks.
If the Customer has ordered a product unavailable after the validation of his order, he will be informed immediately.
The Seller will cancel the purchase, and if the amount has already been debited, the Customer will be refunded as soon as possible.

5 - ORDER

The Customer has the possibility to order the products directly on the website every day of the year, at any time, except when the website is temporarily under maintenance or unavailable for any other reason.
To place an order on the website, the Customer chooses his articles and adds them to the basket then validates the contents of his basket.

Step "Connection":

- If the Customer already has a Customer account on the website, he must identify himself.
- If the Customer does not have a Customer account on the website, he can create one (the creation of a Customer account is free and optional for ordering).

Step "Address":

The Customer checks and validates the delivery and billing address. He can also add a comment about his order in the field dedicated to this, at this step of the order.

Step "Shipping":

The Customer selects a delivery method available for the delivery address indicated in the previous step.
The Customer must read the General Terms and conditions of sale, then check the box "I certify to have read and accepted the general terms and conditions of sale" in order to proceed to the payment of his order.

Step "Payment":

The Customer checks the summary of his order then selects a payment method, these are displayed below the summary of his order.
The Customer will receive an e-mail confirmation of his order on the e-mail address that he has indicated when creating his account.
The transfer of ownership of the product will only take place with the full payment of his order.

6 - DELIVERY

The seller delivers worldwide.
Delivery in France is free from 75 euros all taxes included.
Shipping costs for foreign countries depend on the total weight of the order.
The delivery takes place at the address indicated by the Customer.
The proposed carriers are the following ones:

- So Colissimo (La Poste)
- Chronopost

Delivery times are given as an indication. They can evolve due to different factors like carrier availability, order processing etc.

7 - TERMS OF PAYMENT

Several means of payment are accepted.
As a Customer, the latter can pay by: credit card (credit card, visa, master card, eurocard, american express) / PayPal / bank transfer
When paying online by credit card, the Customer indicates the number of his credit card, its expiry date and the 3 numbers on the back of it.
Online payment is secured via HTTPS connection with SSL certificate.
the Seller requires full payment of the order.

8 - RIGHT TO WITHDRAW

The Customer has a right of withdrawal to exercise within thirty working days from receipt of the ARTICLE. He has neither to justify reasons, nor to pay penalties.
Before any return, the Customer must contact the Seller to inform him about the exercise of his right of retraction by using the contact form.
The return costs are free for France if the shipping costs of this order were not free. In any other case, the cost of return are the responsibility of the Customer.
The expenses of forwarding of one or more articles in the case of an exchange, are free.
The right of retraction does not apply to products that are inherently perishable or can not be reshipped (such as gift cards).
Customer must reship the product within the time period specified above.

> In order for the returned product to be marketable again, the Customer undertakes to return it in its original packaging and in perfect condition.
The packaging can be opened and the ARTICLE used, as long as it is can be marketed.

9 - RIGHT TO RETURN PRODUCT (defective)

In case of a defect, the Seller undertakes to replace the product or to refund the Customer as soon as possible.

10 - CONDITIONS AND TIME LIMITS FOR REFUND

Product refund is full. It is made by bank transfer or PayPal as soon as possible and at the latest within 30 days from the date of exercise of the right of retraction.

11 - CONSUMER CLAIMS

Any complaint from the Customer is to be sent electronically to contact@exentrikco.com.

12 - INTELLECTUAL PROPERTY

All comments, images, illustrations of the website are exclusively reserved for this one.
Under intellectual property and copyright, any use is prohibited except for private use.
Without prior permission, any reproduction of the website, whether partial or total, is strictly prohibited.

13 - RESPONSIBILITY

In accordance with Article 1147 of the Civil Code, the Seller incurs contractual liability with regard to the Customer in case of non-performance or improper performance of the contract concluded.
However, the contractual liability of the Seller can not be engaged in the situations mentioned below:

- case of major force;
- foreign fact that can not be attributed to the Seller;

Eventually:

The photographs and images of the website have no contractual value. They can not therefore engage the responsibility of the Seller.

14 - PERSONAL DATA

Some information relating to the Customer will be transmitted to the Seller (namely name, address, postal code and telephone number), in order to allow the processing and delivery of the products ordered.
The website's commercial offers will be sent to the Customer by email if no opposition has been issued. The Customer may at any time oppose the commercial offers at no charge by connecting to his personal space or by contacting the Seller electronically at contact@exentrikco.com.
The website ensures the Customer collection and processing of personal information in respect of privacy in accordance with Law No. 78-17 of 6 January 1978 relating to data, files and freedoms.
The website is registered to the CNIL under the number XXXXXX.
Pursuant to articles 39 and 40 of the law dated January 6, 1978, the Customer has a right of access, rectification, cancellation and opposition of his personal data.
The Customer exercises this right via:

15 - COMPETENT JURISDICTION AND APPLICABLE LAW

In the event of a dispute between the Customer and EXENTRIK SAS, the applicable law is the French law.
The Customer has the possibility to seize a consumer ombudsman.
The French courts have sole jurisdiction to settle the dispute. The French courts are the only ones competent in case of litigation.
